Inhoudsindicatie:

Vordering van VvE tot veroordeling van voormalig appartementseigenaar in bijdrage in de kosten van beheer en onderhoud van appartementencomplex. Beroep op opschortingsrecht wordt afgewezen nu gedaagde de speciale rechtsgang als vermeld in artikel 5:121 BW niet heeft benut. Beroep op verrekening wordt gepasseerd omdat gegrondheid van dit verweer niet op eenvoudige wijze is vast te stellen.
